Agreement to Terms

By downloading, installing, or using the ThirstTrapp mobile application ("App"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the App.

ThirstTrapp is developed and operated by Andreas Buciuman ("Service Provider," "we," "us," or "our").

What ThirstTrapp Does

ThirstTrapp is a personal wellness app that helps you build better hydration habits using:

Computer vision to detect when you drink water via your device's front-facing camera
Optional app usage management that allows you to set self-imposed time limits on selected apps, which unlock when you meet your hydration goals

Important: All features are voluntary and self-imposed. You control what limits you set, which apps are managed, and can disable any restrictions at any time.

User Responsibility & Voluntary Use

Self-Imposed Restrictions

All app time limits and restrictions are set by you, for yourself
You can disable, modify, or remove any restrictions at any time through the App settings
ThirstTrapp is a tool for personal self-improvement, not enforcement

Not for Monitoring Others

ThirstTrapp is not designed as parental controls or for monitoring other people
Do not use this App to restrict others' device access without their explicit, informed consent
Parents/guardians: If allowing minors to use this App, ensure they understand it's for voluntary self-management

Emergency Access Warning

Critical: If you enable app blocking features, ensure you maintain access to emergency services, communication apps, and critical functionality.

You are solely responsible for any consequences of blocking access to apps
The Service Provider is not liable for inability to access blocked apps in emergency situations

Personal Responsibility

You are responsible for setting appropriate hydration goals for your health needs
You are responsible for choosing which apps to manage and setting reasonable time limits
You are responsible for ensuring the App's restrictions don't interfere with work, school, or essential communications

Health Disclaimer

ThirstTrapp is not medical advice.

This App is for general wellness and habit-building purposes only
Hydration needs vary by individual, activity level, climate, and health conditions
Do not rely solely on this App for medical guidance about hydration
Consult a healthcare professional before making significant changes to your hydration habits
If you have medical conditions affecting fluid intake (kidney disease, heart conditions, etc.), consult your doctor before using this App

The Service Provider is not responsible for any health outcomes related to your use of this App.

Required Permissions

To function properly, ThirstTrapp requires:

Camera (Required)

Used exclusively for detecting drinking activity via computer vision
No video is captured, stored, or transmitted (see Privacy Policy)
You must grant camera permission for core functionality
Can be revoked anytime in iOS Settings, but the App will not function without it

Screen Time API (Optional)

Required only if you choose to enable app blocking features
Allows the App to monitor and restrict usage of selected apps
Can be disabled at any time in iOS Settings

Notifications (Optional)

For hydration reminders
Can be disabled in iOS Settings

Subscription & Payment

Subscription Model

ThirstTrapp requires an active subscription, billed through the Apple App Store.

Subscription Terms:

Billing: Subscriptions are charged to your Apple ID account
Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Pricing: Current subscription prices are displayed in the App Store and may vary by region
Price Changes: We reserve the right to modify subscription prices with advance notice. Existing subscribers will be notified before any price increase takes effect

Managing Your Subscription:

Cancellation: Cancel anytime through App Store → Account → Subscriptions
No Partial Refunds: If you cancel, you'll have access until the end of your current billing period. No refunds for partial periods
Reactivation: Cancelled subscriptions can be reactivated through the App Store

Free Trials (if applicable):

If a free trial is offered, you'll be charged when the trial ends unless you cancel before the trial period expires
Unused portions of free trials are forfeited upon subscription purchase

Refunds:

All subscription purchases are subject to Apple's standard refund policy. Contact Apple Support for refund requests. We do not process refunds directly.

Intellectual Property

The ThirstTrapp App, including its code, design, graphics, user interface, and branding, is owned by Andreas Buciuman and protected by copyright and intellectual property laws.

You may not:

Copy, modify, or reverse-engineer the App
Extract source code or create derivative works
Remove copyright notices or branding
Distribute, sell, or sublicense the App

Your license to use ThirstTrapp is personal, non-transferable, and revocable.

Device Security

Jailbreaking/Rooting

We strongly advise against using ThirstTrapp on jailbroken or rooted devices. Such modifications:

May compromise the App's functionality
May expose your device to security vulnerabilities
Void any support obligations from the Service Provider

You use ThirstTrapp on modified devices at your own risk.

Internet & Data Usage

Fully Offline Operation

After initial download, ThirstTrapp functions entirely offline.

No internet connection is required for any functionality
All processing happens on your device
No data is transmitted to external servers (see Privacy Policy)

The only internet usage is for:

Initial app download from the App Store
Future app updates (optional)

If you download the App or updates over cellular data, standard carrier charges may apply.

No Warranty / Limitation of Liability

The App is provided "AS IS" without warranties of any kind.

To the maximum extent permitted by law:

We Do Not Guarantee:

That the App will be error-free, uninterrupted, or secure
That camera-based drinking detection will be 100% accurate
That the App will meet your specific hydration or screen time goals
Compatibility with all devices or future iOS versions

We Are Not Liable For:

Any damages arising from use or inability to use the App
Inaccurate drinking detection or hydration tracking
Consequences of app blocking (missed calls, messages, work/school access, emergencies)
Health outcomes related to hydration changes
Data loss (though we don't collect data - see Privacy Policy)
Third-party claims arising from your use of the App

Maximum Liability

Our total liability for any claims related to ThirstTrapp shall not exceed the amount you paid for your current subscription period, or €50 EUR, whichever is greater.

Updates & Changes to the App

We may update ThirstTrapp to add features, fix bugs, or improve performance
Updates may require the latest iOS version
We do not guarantee indefinite support for all iOS versions
You are responsible for keeping your device and the App updated
We reserve the right to discontinue features or the entire App with reasonable notice

Termination

You May:

Cancel your subscription at any time through the App Store
Stop using the App at any time
Delete the App from your device, which removes all local data

We May:

Terminate or suspend the App's availability with reasonable notice
Discontinue support for older iOS versions
Modify or remove features in future updates

Upon termination, your license to use the App ends. If you cancel your subscription, you'll retain access until the end of your current billing period.

Privacy

Your privacy is paramount. Please review our Privacy Policy to understand how ThirstTrapp handles (or rather, doesn't handle) your data.

Key points:

Zero data collection
On-device processing only
No cloud storage or transmission
No third-party data sharing

Children's Use

While ThirstTrapp does not collect data (including from children), parental guidance is recommended for users under 18.

Parents/Guardians:

Ensure your child understands the App is for voluntary self-management
Supervise their use of app blocking features
Ensure restrictions don't interfere with school, family communication, or emergency access
Confirm hydration goals are age-appropriate
Monitor subscription charges through your Apple ID Family Sharing settings

Changes to These Terms

We may update these Terms & Conditions periodically. Changes will be indicated by updating the "Last Updated" date at the top.

How you'll be notified:

Material changes will be announced through an App update notice
You are responsible for reviewing these Terms periodically
Continued use after changes constitutes acceptance of new terms

Governing Law & Dispute Resolution

These Terms are governed by the laws of Romania and the European Union, without regard to conflict of law principles.

EU Consumer Rights

If you are a consumer in the European Union, you benefit from mandatory consumer protection provisions under EU law, including:

14-Day Withdrawal Right: EU consumers have the right to cancel certain purchases within 14 days. However, digital content (apps) is exempt once you begin downloading/using the app with your consent
Unfair Terms Protection: Any terms deemed unfair under EU law are not binding
Dispute Resolution: You may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr

Jurisdiction

Any disputes shall be resolved in the courts of Romania, or your local jurisdiction if required by consumer protection laws.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Service Provider regarding ThirstTrapp.
